Fees and Requirements

  • Only a QUALIFIED applicant may obtain a copy of a birth or death certificate.

    • The registrant - This is the person named in the record.
    • The parent, child, brother, sister, spouse, grandparent, legal guardian or managing conservator, or the registrant.
    • Legal representative, agent, or other person acting under contract for the registrant. Must provide legal documentation authorizing access.

    The applicant must provide the following information and show proper identification:

    Birth Certificate - $23 per Certified Copy

    *Must present a valid Driver's License or Government issued ID (ie. school, passport, incarcerated, military service, etc.)

    • Full name on birth certificate
    • Date and place of birth
    • Father's full name
    • Mother's maiden name
    • Name, address, and phone number of the requestor
    • Relationship to the person on the birth record

    *Any Texas birth certificate may be immediately purchased in Titus County. This office uses a remote access system to the state's records dating from 1926 to present. Call to confirm for home births.

    Death Certificate - $21 for First Copy/$4 for additional
    • Call to confirm prior to request.
    • Full name on death record
    • Date and place of death
    • Father's full name
    • Mother's maiden name
    • Name, address, and phone number of the requestor
    • Relationship to the person on the death record

    *All deaths recorded in Titus County from 1903 to present are available.

    Certificate by Mail

    To obtain a birth or death certificate by mail, complete the application form and a copy of the applicant's valid driver's license or other valid picture identification, along with a certified check or United States money order payable to TITUS COUNTY CLERK. The application form and the notary form MUST be printed on separate pieces of paper. Do NOT print them two-sided on the same sheet of paper. Please provide a self addressed stamped envelope.

  • Requirements
    Livestock is required to have distinct earmarks and brands which shall be recorded with the County Clerk in the county of which the livestock is located according to the Texas Agriculture Code, Sections 144.041-144.004. The County Clerk is required to maintain a record of all livestock marks and brands. $25.00 per brand or mark and $5.00 per additional location on the animal Record all marks and brands every ten years with the county clerk beginning August 30, 2011. The procedure for preserving Marks and Brands is: 1) the Mark and Brand will be electronically delivered to the Texas State Cattle Association and 2) the information will be retained electronically and in a book for reference in the County Clerk's office.


    ESTRAY ACT (Stray Livestock):
    The Texas Agriculture Code, Section 142 provides for a method of disposing estray livestock. The Office of Sheriff has the authority to capture and impound all stray livestock, prepare a notice of estray, file the notice with the county clerk, publish notice of the impoundment in a newspaper of general circulation at least twice during a 15 day period and post notice on the public notice board of the courthouse.

    If the owner of the estray is not determined or claimed before the 18th day, the sheriff shall cause the estray to be sold at a public sale or auction and a report of the sale is filed with the county clerk.

  • Requirements

    • Both parties must appear to apply.
    • Must be 18 years of age
    • proof of age and identity (valid drivers license, passport, etc.)
    • A divorce by either party must be final 30 days prior to applying for the marriage license

    Prior to applying for a marriage license in the state of Texas the following things should be considered:

    •  A license purchased in any Texas county can be used in the state of Texas and any other state or country that will accept it. (Including: ceremony performed on an aircraft, boat or ship traveling in the us or international territory.)
    • It may be used in any county in Texas
    • The original license will be returned to you after it is filed.
    • The license will remain on file in the county where it was purchased.
    • Certified copies may be ordered from that county at any time.
    • When a license is purchased it may not be used for the first 72 hours.
    • A district judge may waive the waiting period if a timely request is made.
    • The license is valid for ninety (90) days from the date of purchase.
    • There is no law requiring a blood test.
    • Couples living as husband and wife may wish to make their marriage a matter of record without formal ceremony. Call for additional information on an informal marriage declaration.

  • The military services encourages military personnel to file their official discharge with the county clerk in the county of residence. This includes members of the United States armed forces, the United States armed forces reserve, or an armed forces auxiliary.

    Texas Local Government Code, Section 192.002 authorizes the county clerk to file the military discharge at no cost.

    By filing the military discharge form in the public records, a permanent record is maintained for future proof of service for veterans’ benefits. The original is returned to the owner after recording.

    UCC FEES
    County Clerk no longer accepts UCC filings except in Real Estate Records. All other UCC will now be filed with the Secretary of State in Austin. Therefore, we now only accept Terminations through the UCC forms. All other UCC filed through the Real Records.

    Please ensure that all text are legible and of sufficient size for proper viewing. No smaller than 8 point font is acceptable. If document has been shrunk to fit page, then the font is no longer 8 point font and is not acceptable.

    The Texas Legislature recently amended the Property Code to provide a streamlined procedure for addressing discriminatory provisions in real property records. Although state law already declared restrictions and provisions in real property records that prohibit the use, sale or transfer of real property to a person based on race, color, religion, or national origin to be void and unenforceable, Senate Bill 30, which took effect on September 1, 2021, establishes a process for a property owner, or another person that the owner authorizes, to request a judicial review of specific property records to determine whether they contain prohibited discriminatory provisions.

    The bill sets out the contents of the documents required to be submitted to the court as well as a suggested format for the court's findings and order. Under certain circumstances, the court may issue its determination without conducting a hearing. No filing fees may be charged under the statute.
